2. General Provisions
2.1. These Rules determine the procedure and conditions for the provision of services by the Operator and are an integral part of the Contract. The Rules apply to individuals, legal entities and sole proprietors; the specifics for each category are set out in sections 8-A and 8-B. To customers under Federal Laws No. 44-FZ and No. 223-FZ, the Rules apply to the extent not regulated by the contract (agreement). The terms "Contractor", "Customer" and "Specification" in the contract (agreement) correspond to the terms "Operator", "Subscriber" and "Connection Application".
2.2. In the event of a discrepancy between the Rules and the text of the Contract signed by the parties, the Contract applies. In the event of a discrepancy between the Rules and the law, the law applies.
2.3. The Operator provides services on the basis of Roskomnadzor licenses No. Л030-00114-77/00644525 and No. Л030-00114-77/00644527 (valid until 22.03.2028), in the territory of the city of Khabarovsk and the Jewish Autonomous Region (urban-type settlement Priamursky, village of Nikolaevka, village of Klyuchevoe, village of Kamyshovka).
2.4. The relations of the parties are governed by the Civil Code of the Russian Federation, Federal Law No. 126-FZ of 07.07.2003 "On Communications", the Rules for Rendering Data Transmission Communication Services (Resolution of the Government of the Russian Federation No. 2606 of 31.12.2021), the Rules for Rendering Telematic Communication Services (Resolution of the Government of the Russian Federation No. 2607 of 31.12.2021), and, for subscribers who are individuals, also by the Law of the Russian Federation "On Consumer Rights Protection".
2.5. The Operator does not give preference to some subscribers over others, unless otherwise provided by law. To provide services, perform work and accept payments, the Operator may engage third parties, while remaining responsible to the Subscriber.
2.6. Personal data. The Operator processes the personal data of Subscribers, their representatives and Users in order to conclude and perform the Contract, make settlements, consider requests and perform the duties of a communications operator established by law (clauses 2 and 5 of Part 1 of Article 6 of Federal Law No. 152-FZ of 27.07.2006 "On Personal Data", Articles 44, 53, 64 of the Federal Law "On Communications"). Consent to such processing is not required. The Operator may entrust the processing to third parties for the purpose of performing the Contract (acceptance of payments, installation and repair, the Partner's services), while remaining responsible to the Subscriber. The data are stored during the term of the Contract and for the periods established by law after its termination. Processing for other purposes (advertising, mailings, surveys) is carried out only with separate consent, which the Subscriber may refuse to give and may withdraw at any time. Personal Data Processing Policy: https://bravotele.com/docs/privacy/.
2.7. The Operator may publish aggregated information on the use of services without identifying specific subscribers. Advertising messages are sent to the Subscriber only with the Subscriber's consent, which may be withdrawn at any time.
3. Services and the Procedure for Providing Them
3.1. The Operator provides the following services:
- telematic communication services, including access to the Internet;
- data transmission communication services, including the provision of a data transmission channel;
- additional services: static IP address and other services according to the tariffs;
- the Partner's interactive television, including as part of "Internet + TV" plans and as TV services (section 12);
- other services under separate Connection Applications and tariffs (dedicated channels, IP address subnets and others);
- work: connection, installation and relocation of wiring, equipment setup, a technician's visit - according to the tariffs.
3.1.1. Subscriber interface: Ethernet (RJ-45 connector), connection via the PPPoE protocol with the Personal Account credentials. The specific interface and equipment are specified in the Connection Application. The service quality indicators and requirements for subscriber equipment are set out in the Technical Conditions.
3.2. Services are provided subject to technical feasibility, serviceable subscriber equipment and funds in the Personal Account (section 8). Services are provided around the clock, except for technical breaks (clause 6.1).
3.3. The provision of services under a Connection Application begins on the date of first activation (clause 4.1.1).
3.4. Suspension at the Operator's initiative. The Operator suspends the provision of services:
- if there are insufficient funds in the Personal Account to pay for the services of the billing period (advance payment system). The Operator reminds the Subscriber in advance about payment in the Customer Account and (or) by SMS;
- if the Subscriber violates the law, the Contract or the Rules (including clauses 7.3 and 11.4) - with notice to the Subscriber, until the violation is remedied;
- at the request of authorized state bodies in the cases provided for by law.
3.5. During a suspension due to insufficient funds, the Customer Account and the payment pages remain available to the Subscriber. The provision of services resumes automatically after receipt of an amount sufficient for payment according to the tariff (clauses 8-A.3, 8-A.4, 8-B.5), or after the "Promised payment" service is turned on (clause 8.7). Television under an "Internet + TV" plan, a TV service and 24TV packages are suspended and resumed together with Internet access (clause 12.8).
3.6. When suspending services under clause 3.4, the Operator sends the Subscriber a notice (clause 13.2). If the Subscriber has not remedied the violation within 6 months from the date of receipt of the notice, the Operator may unilaterally terminate the Contract (clause 3 of Article 44 of the Federal Law "On Communications"). After termination, the Operator may disconnect the subscriber line from the Network and recover the debt.
3.7. Voluntary suspension. If the Subscriber does not plan to use the services (vacation, going away), the Subscriber must notify the Operator in advance of the date from which the suspension is needed - in the Customer Account (suspension from the 1st day of the following month) or by phone +7-914-419-60-03 with confirmation by the code word (suspension from any date). From that date, the suspension service (below) is connected to the Personal Account, and the fee for the month is calculated in proportion to the days. The suspension period is not limited (for example, for a year while away). Mandatory condition: the Personal Account must have sufficient funds to pay for the suspension service (and the static IP address, if connected) for the entire suspension period. If there are no funds, the suspension is not arranged. If the funds run out during the suspension, the rules on debt (clause 8-A.3) and suspension apply, and in the event of non-payment within 6 months after the notice, the Operator may unilaterally terminate the Contract (clause 3 of Article 44 of the Federal Law "On Communications").
For Subscribers connected by an optical line or cable that uses an Operator's port, the "Port reservation during voluntary suspension" service is connected for the suspension period at the Operator's tariffs: the port and the line remain reserved for the Subscriber. For Subscribers connected by another technology that does not require the use of an Operator's port, no reservation is required: for the suspension period the account is disabled without any fee being charged.
Television under an "Internet + TV" plan is not provided during the suspension. TV services and packages connected in the app remain active and are paid for unless the Subscriber has given them up (clause 7.2); their cost is included in the amount sufficient to arrange the suspension.
Restoration: upon the Subscriber's request, the tariff plan is activated at the moment of the request (if there are funds in the Personal Account), and without a request - automatically from the 1st day of the month specified by the Subscriber when arranging the suspension. The static IP address is retained during the suspension and is paid for according to the tariff.
If the Subscriber has not given notice of the suspension, the service is deemed provided and is paid for under clauses 8.3, 8-A.3 and 8-A.4 regardless of actual use.
4. Contract. Change of Services. Termination
4.1. Form of the Contract. For individuals, the Contract is public (clause 26 of Government Resolution No. 2607): these Rules together with the tariffs constitute the Operator's public offer published on the website. An individual accepts the offer (acceptance) by signing the Application to Join via "Goskey"; in this case the Subscriber's identity is confirmed via ESIA (the Unified Identification and Authentication System, "Gosuslugi"), clause 28 of Government Resolution No. 2607. If signing via "Goskey" is impossible, the Application is signed on paper upon presentation of an identity document. From the moment the Application is signed, the Contract is deemed concluded in writing (clause 20 of Government Resolution No. 2607, Articles 434, 437, 438 of the Civil Code of the Russian Federation). Legal entities and sole proprietors conclude the Contract in writing on paper or via EDI. The integral parts of the Contract are these Rules, the Connection Application for each connection point (for individuals - the Application to Join) and the tariffs. Each connection point is arranged by a separate Connection Application; each Connection Application is assigned a separate Personal Account with its own login and password. For individuals, the Personal Account number of the first connection point coincides with the Contract number. The Operator may refuse to conclude the Contract only if there is no technical possibility of connection at the specified address.
4.1.1. Date of conclusion and first activation. The date of conclusion of the Contract is the day the Application to Join (for legal entities and sole proprietors - the Contract) is signed. Fees for services are charged not from the date of conclusion, but from the date of first activation - the first activation of any service on the Personal Account. For the first (incomplete) month, the subscription fee is calculated in proportion to the days from the date of first activation, thereafter - in the general procedure (clause 8.2). The date of first activation is recorded in the Operator's billing system and displayed in the Customer Account. The cost of connection work is paid separately according to the tariff.
4.1.2. The Contract is concluded for an indefinite term, unless a different term is specified in it. The Connection Application remains in effect until the Subscriber gives up the connection point or until the Contract is terminated.
4.2. To conclude the Contract, the Subscriber provides the information required by Government Resolutions No. 2606 and No. 2607: an individual - full name, date of birth, details of the identity document, address; a legal entity and a sole proprietor - name, address, OGRN (OGRNIP), INN, documents confirming the representative's authority. The Subscriber is responsible for the accuracy of the information.
4.3. The login, temporary password and code word are specified in the Connection Application (for individuals - in the Application to Join) and are issued only to the Subscriber or the Subscriber's authorized representative. On the first login to the Customer Account, the Subscriber must change the temporary password. Lost credentials are restored upon a request made from the contacts specified in the Contract, after confirmation by the code word or the Contract details. Actions performed in the Customer Account under the Subscriber's credentials are deemed performed by the Subscriber; entering the login and password constitutes the Subscriber's simple electronic signature (Part 2 of Article 6 of Federal Law No. 63-FZ "On Electronic Signature"). The procedure for using the Customer Account is set out in the Customer Account User Agreement on the Operator's website.
4.4. In communal apartments and premises with several owners, a contract is concluded with each subscriber separately.
4.5. Change of services. The Subscriber changes the tariff plan and additional services in the Customer Account, by written application, via EDI or by phone with confirmation by the code word. A change of tariff plan in the Customer Account takes effect from the 1st day of the following month; by phone or by application - from the 1st day of the following month or, at the Subscriber's choice, from the date of the request, with proportional calculation for an incomplete month. TV services (clause 12.6) are connected in the Customer Account immediately, other additional services - from the date agreed with the Operator; the fee for an incomplete month is calculated in proportion to the days. A new connection point for a subscriber of any category is arranged by a separate Connection Application without re-concluding the Contract.
4.6. Equipment rental. If the Operator leases equipment, its name, serial number, cost and rent are specified in the Connection Application; the parties' signatures on the Connection Application replace the acceptance and transfer certificate. Upon termination of the lease, the equipment is returned in working condition, allowing for normal wear and tear; in case of loss, the Subscriber reimburses the cost specified in the Connection Application.
4.7. Termination. The Subscriber may withdraw from the Contract at any time by submitting an application. The Contract is terminated from the date of registration of the application or from a later date specified in it. The fee for the last month is calculated in proportion to the days of service provision. The remaining advance is refunded within 10 days from the date of receipt of the application with bank details: to an individual - to his or her bank account or card, to a legal entity and a sole proprietor - to the settlement account. Debt and unreturned equipment are recovered after termination as well.
4.8. When the Subscriber moves or the right to use the premises ceases, the services at the old address are terminated; at a new address within the service area, the services are arranged by a new Connection Application without re-concluding the Contract.
4.8.1. Re-registration. If the connection at the same address is to be used by another person (a new owner or tenant of the premises, a family member, an heir), the former and the new subscriber submit a joint application for re-registration. The Contract with the former Subscriber for this connection point is terminated (clause 4.7), and the new subscriber concludes their own Contract (clause 4.1); the connection is not interrupted, and no repeat installation or connection fee is needed. The former Subscriber's debt is repaid before the re-registration. The remaining advance payment, upon the former Subscriber's application, is refunded to them (clause 4.7) or transferred to the new subscriber's Personal Account. If the former Subscriber has died, a copy of the death certificate is attached instead of their signature, and the remaining advance payment is transferred or refunded to the heir according to the inheritance documents.
4.9. The Operator may unilaterally terminate the Contract in the cases provided for by clause 3.6 and by law.
5. Connection, Subscriber Line, Repair
5.1. Connection is performed within the period agreed with the Subscriber. If there is no technical possibility, the Operator informs the Subscriber of this and refunds the money paid.
5.2. During connection, the Operator lays the subscriber line from the Network equipment to the Subscriber's premises, brings the cable into the premises and runs it to the place where the equipment is installed. The connection cost includes the cable inside the premises from the entry point to the place where the equipment is installed, as needed along the route agreed during connection, but no more than 20 metres; cable beyond 20 metres is paid for according to the tariff. 20 metres is a limit, not an allowance: the Operator lays as much cable as the route needs; the remaining length up to 20 metres is not handed over to the Subscriber and is not left as a spare (coil). The Operator does not perform finishing work inside the premises (cable ducts, skirting boards, drilling walls), unless otherwise agreed in the Connection Application for a separate fee.
5.2.1. Line on the Subscriber's land plot and building. In a private house and any other building on the Subscriber's land plot, the section of the subscriber line over the land plot, on the building and inside it, as well as the equipment installed there, are placed with the Subscriber's consent expressed in the Connection Application, for the term of the Contract. The Subscriber confirms that they are the owner (lawful possessor) of the land plot and the building or have obtained the owner's consent. The Operator acquires no right to use the Subscriber's land plot and building (easement). This section of the line is on the Subscriber's side (Boundary of responsibility): the Subscriber ensures its safety, including during construction and roofing work, tree trimming and falling trees, and the operation of machinery on the plot. Damage to this section is repaired at the Subscriber's request according to the tariff (clause 5.7.1), except for defects in the Operator's work and equipment within the warranty (clause 5.6); the line is moved under clause 5.8. Over someone else's land plot, the subscriber line is laid only with the written consent of its owner.
5.3. During connection, the Operator helps the Subscriber with the initial setup of the Subscriber's router. The Operator is not responsible for the operation and settings of the Subscriber's own equipment, including the Wi-Fi wireless network.
5.4. Wiring not installed by the Operator may be used after it has been checked by the Operator; in this case, the quality of services is guaranteed only up to the point where this wiring is connected to the Network.
5.5. Connection work is confirmed by the Subscriber's signature on the Application to Join or the Connection Application (individuals) or on the UPD (universal transfer document) (legal entities and sole proprietors, clause 8-B.6).
5.6. Warranty. For a subscriber line laid by the Operator - 12 months; for equipment purchased from the Operator - the manufacturer's warranty period. The warranty does not cover damage caused by the fault of the Subscriber or third parties, unauthorized alterations to the wiring, fire, flooding, lightning, violation of electrical safety requirements and natural disasters.
5.7. Repair. Repair requests are accepted in the Customer Account, by phone and by email (section 13); messages in other channels, including VKontakte, are considered after they are registered by an operator. The Operator first performs remote diagnostics. Network faults are eliminated at the Operator's expense within periods counted from the moment the request is registered: up to 72 hours - faults of the Operator's equipment and subscriber line on the Operator's side (Boundary of responsibility); up to 7 days - damage to fiber-optic and other trunk communication lines, poles and masts. The periods are extended for the time during which work is impossible: no access to the premises, the roof or the poles, adverse weather (thunderstorm, strong wind, ice), the circumstances of clause 10.7. The time of a visit to the Subscriber's premises is agreed with the Subscriber.
5.7.1. Paid repair. If diagnostics or a visit establishes that the fault is on the Subscriber's side (the Subscriber's equipment, settings, Wi-Fi, wiring in the premises, the section of the subscriber line and equipment on the Subscriber's side (clause 5.2.1), power supply, damage caused by the fault of the Subscriber or third parties) or that there is no fault, the visit and work are paid for by the Subscriber according to the tariff. When accepting the request, the Operator warns the Subscriber that the visit may be chargeable. The cost of the visit is communicated to the Subscriber before the visit.
5.7.2. Repeat visit. If a visit at the agreed time did not take place or the work was not done for reasons on the Subscriber's side (the Subscriber or their representative is not at the place at the time of the visit; the Subscriber did not warn in advance about rescheduling the visit; access to the premises, land plot or line was not provided; the Subscriber's equipment was not ready or the conditions agreed with the Subscriber were not met), the repeat visit is paid for by the Subscriber according to the tariff.
5.8. Relocation of the subscriber line and reconnection after the line has been disconnected are performed at the Subscriber's request and are paid for according to the tariff.
6. Rights and Obligations of the Operator
6.1. The Operator must:
- provide services around the clock and in accordance with the tariff. Scheduled technical breaks - no more than 24 hours per month, mainly at night, with notice no later than 24 hours in advance on the website and in the Customer Account;
- eliminate Network faults within the periods of clause 5.7;
- notify Subscribers of changes to the tariffs and the Rules at least 10 days before they are introduced - on the website and in the Customer Account, and legal entities and sole proprietors also by email or via EDI;
- observe the secrecy of communications (Article 63 of the Federal Law "On Communications") and the confidentiality of information about Subscribers, except in the cases provided for by law;
- provide the Subscriber with access to the Customer Account with information on the balance, charges and services consumed;
- advise the Subscriber on matters of service provision free of charge.
6.2. The Operator may:
- change the tariffs with notice under clause 6.1; change the Rules with the same notice: for legal entities and sole proprietors - in any part, for individuals - only in the cases provided for by law or if the change does not worsen the Subscriber's position (clause 2 of Article 16 of the Law of the Russian Federation "On Consumer Rights Protection"). A Subscriber who does not agree with the changes may terminate the Contract without deductions (clause 4.7);
- suspend the provision of services in the cases of clause 3.4;
- temporarily restrict individual protocols and ports to protect the Network from attacks, virus epidemics and network storms;
- suspend services without prior notice for the duration of emergency work;
- engage third parties for connection, maintenance and acceptance of payments;
- unilaterally terminate the Contract in the case of clause 3.6 and in other cases expressly provided for by law.
7. Rights and Obligations of the Subscriber
7.1. The Subscriber must:
- pay for services in a timely manner and in full and monitor the balance of the Personal Account independently;
- monitor the information that the Operator posts on its website and in the Customer Account, including about changes to the tariffs, the Rules, bank details, telephone numbers, email addresses and other contact details of the Operator;
- use serviceable subscriber equipment that meets the established requirements, observe electrical safety measures and disconnect the equipment from the Network during a thunderstorm;
- keep the login, password and code word secret;
- provide the Operator's employees with access to the premises, and in a private house also to the land plot and to the places where the line and equipment are placed on the building, for connection, inspection, repair and disconnection of the line at an agreed time;
- ensure the safety of the subscriber line and equipment on their side of the Boundary of responsibility, in a private house - on their land plot and building (clause 5.2.1);
- within 30 days, inform the Operator of a change of full name (name of the entity), address, telephone number, email, identity document, and of the termination of the right to use the premises;
- a legal entity and a sole proprietor - within 15 days from the date of conclusion of the Contract, provide the Operator with a list of Users (full name, date of birth, details of the identity document) and report changes in the list of Users within the same period (clause 35(z) of Government Resolution No. 2607). The Subscriber notifies the Users of the transfer of their data to the Operator and of the purposes of processing;
- return the leased equipment upon termination of the Contract.
7.2. The Subscriber may:
- receive free consultations and reliable information about services and tariffs;
- change the tariff plan and the set of services (clause 4.5), arrange a voluntary suspension (clause 3.7);
- give up any additional service from the 1st day of the following month, and a TV service (clause 12.6) and a service with daily payment - from the date of the application;
- demand elimination of faults and recalculation for breaks caused by the Operator's fault (clause 10.4);
- terminate the Contract at any time (clause 4.7).
7.3. The Subscriber is prohibited from:
- giving access to the services to third parties outside the service address (including to neighbors, by laying a cable or sharing Wi-Fi) and using the services to provide communication services to other persons;
- connecting to the Network without a Contract, changing the network details issued (IP and MAC addresses), attempting to gain unauthorized access to the resources of the Operator and other persons;
- damaging the Network and obstructing the operation of the Operator's services;
- using the services for activities prohibited by law and violating the network usage rules (clause 11.4).
7.4. Actions performed using the Subscriber's connection (on the Subscriber's side of the Boundary of responsibility, including through their router and Wi-Fi network) are deemed to have been performed by the Subscriber unless they prove otherwise. The Subscriber protects their Wi-Fi network with a password and does not allow outsiders to connect.
8. Payment and Settlements
8.1. Services are provided under the advance payment system, unless otherwise established by the Contract. With state and municipal customers, the Contract (contract) is concluded in accordance with Federal Laws No. 44-FZ or No. 223-FZ; the procedure, terms and form of settlements for them are determined by the contract. The cost of services is determined by the tariffs in effect at the time the services are provided. The Operator applies the simplified taxation system; no VAT is charged.
8.2. The subscription fee is debited from the Personal Account on the 1st day of the billing month for the entire month in full, unless the Contract provides for payment after the services are provided. For an incomplete month (connection, suspension, termination, a new additional service), the fee is calculated in proportion to the number of days the service was provided.
8.3. A service that has not been suspended upon the Subscriber's application (clause 3.7) is paid for in full (taking into account clauses 8-A.3 and 8-A.4) regardless of actual use. The unused balance of funds is carried over to the following month.
8.4. Order of debiting. Funds received are credited in the following order: debt for previous periods; connection work and one-time work; equipment rental; Internet access, including under "Internet + TV" plans; static IP address and other additional services, including TV services; 24TV packages connected in the app (clause 12.7); delivery of documents.
8.5. A payment is identified by the Personal Account number. If there is an error in the payment details, the funds are credited after clarification upon the Subscriber's application with a payment document attached. The Operator is not responsible for the time it takes payments to pass through banks and payment systems.
8.6. When a tariff is increased, an advance already paid for future months is applied according to the tariff in effect in the month the service is provided.
8.7. The "Promised payment" service. If access is suspended due to insufficient funds, the Subscriber may, on the warning page or in the "Promised payment" section of the Customer Account, press the "Promise" button - access under the Subscriber's tariff plan for 24 hours from the moment of activation. For each activation, 10 RUB is charged in addition to the subscription fee. Conditions:
- "Promised payment" can be turned on only when the Personal Account balance is negative;
- "Promised payment" is available if the negative balance of the Personal Account does not exceed the monthly subscription fee under the Subscriber's tariff plan;
- "Promised payment" can be turned on repeatedly, but no more than 11 times (up to 11 days); if the debt is not repaid during this time, access is suspended until the debt is repaid in full;
- the conditions are the same for individuals and for legal entities and sole proprietors.
8.8. Invoice. The Subscriber pays for services on the basis of the Contract within the period established by this section, regardless of whether an invoice has been received; the invoice does not change the amount or due date of the payment. The invoice for the billing period (calendar month) is generated by the Operator in the automated billing system and contains the information required by the rules for rendering communication services, including the amount payable, the balance of funds in the Personal Account, the date of issue and the payment due date. The method and address of invoice delivery agreed by the Parties is posting the invoice in the Subscriber's Customer Account or sending it via EDI or to the email address specified in the Contract; the invoice is deemed delivered on the day it is posted (sent). Itemization of the invoice is provided upon the Subscriber's request (clause 9.1).
8.9. Erroneous payments. A payment credited to the Personal Account by mistake of the payer is refunded upon the payer's application with confirmation of the payment within 10 days, less the amounts already debited for services provided.
8.10. Promotions. The terms of promotions (connection discounts, minimum period of use, procedure for losing the discount) are published on the website together with the tariffs and become part of the Contract from the date of connection under the promotion. The terms of a promotion do not limit the Subscriber's right to terminate the Contract; if the discount is lost, the Operator may demand payment of the difference in the cost of connection not exceeding the amount of the discount granted. Personal discounts under the Contract do not apply to "Internet + TV" plans, TV services and the "Static IP address" service, unless the tariffs state otherwise.
8-A. Individuals
8-A.1. The subscription fee is debited from the Personal Account once a month - on the 1st day of the billing month, for the entire month. Therefore, by the 1st day, the Subscriber must ensure a positive balance in the Personal Account of no less than the amount of the subscription fee for the tariff plan and the connected additional services. Funds may be paid in advance for any period, including a year ahead: they are kept in the Personal Account, and the subscription fee is debited from them on the 1st day of each month. The unused balance upon termination of the Contract is refunded upon the Subscriber's application (clause 4.7). The first payment includes the fee for the first (incomplete) month and the cost of connection, if provided for by the tariff.
8-A.2. Payment methods: by bank card and via SBP (the Faster Payments System) in the Customer Account, through payment systems and payment agents using the Personal Account number. Transfers to the Operator's bank details are not accepted from individuals. The current list is on the website. In the event of a dispute about a card payment, the Subscriber provides documents confirming the payment. Payments are accepted by a payment service. The service may charge a fee for the payment; the amount including the fee is shown before the payment is confirmed.
8-A.3. If there are insufficient funds in the Personal Account on the 1st day, access is suspended. If payment is received by the 15th day inclusive, access is resumed, and the subscription fee is charged for the full month under the Subscriber's tariff plan.
8-A.4. If payment has not been received by the 15th day inclusive, the Personal Account is deemed switched to the suspension service (clause 3.7) from the 1st day of that month. If payment is made on the 16th day or later, the Subscriber's tariff plan is activated from the date of payment, and the fee for the month is calculated in proportion to the days: until the date of payment - at the price of the suspension service, from the date of payment - under the Subscriber's tariff plan. This rule applies equally to all subscribers with the advance payment system, including legal entities and sole proprietors. The price of the suspension service is specified in the tariffs.
8-B. Legal Entities and Sole Proprietors
8-B.1. The first payment - an advance for the first (incomplete) month under the tariff of the Connection Application and the cost of connection work, if provided for by the tariff - is made before the connection work begins, on the basis of the Contract and the Connection Application.
8-B.2. The Subscriber pays for services on its own initiative, on the basis of the Contract, without waiting for an invoice: an advance in the amount of the full monthly fee for all services under all Connection Applications must be received in the Operator's settlement account before the 1st day of the billing month. The amount of the monthly payment is specified in the Connection Application and in the Customer Account. Upon the Subscriber's application, the advance may be paid for several months at once.
8-B.3. Legal entities and sole proprietors pay for services only by bank transfer to the Operator's settlement account; payment by bank card and through payment services is not accepted from them. The Personal Account number is indicated in the payment order. The payment obligation is fulfilled on the day the funds are credited to the Operator's settlement account. Before payment, the Subscriber checks the Operator's details against the invoice or section 13. The risk of payment to the previous details after notice of their change is borne by the Subscriber.
8-B.4. The invoice for the advance is issued no later than the 25th day. The method and address of invoice delivery is posting in the Customer Account or sending via EDI or to the Subscriber's email specified in the Contract (clause 8.8). Failure to receive an invoice does not release from payment and does not change the payment due date.
8-B.5. If the advance has not been received by the 1st day, the provision of services is suspended (clause 3.4); a notice is posted in the Customer Account, and a warning about this is also contained in the invoice for the advance. Services are resumed on the day the payment is credited or a payment order bearing the bank's mark is presented.
8-B.6. Closing documents. The UPD (status "2", without VAT) for the services of the month is issued on the last day of that month and sent to the Subscriber via EDI. Within 5 working days (unless a different period is established by the Contract), the Subscriber signs it or sends a reasoned refusal. If no refusal has been received within this period, the services are deemed properly provided and accepted.
8-B.7. Delivery of documents. Invoices, UPDs and reconciliation statements are sent via EDI or by email free of charge. Paper originals by post are the paid "Delivery of Documents" service: 200 RUB for each mailing (monthly or one-time).
8-B.8. A reconciliation statement is drawn up at the request of either party within 10 working days.
9. Applications and Claims
9.1. Claims are accepted in writing: in the Customer Account, by email, via EDI or by post to the addresses in section 13. Applications for a change of services, suspension and repair are also accepted by phone with confirmation by the code word. Each request is registered.
9.2. A claim may be submitted within 6 months from the date the service was provided, refused or invoiced. The claim must be accompanied by a copy of the Contract or the Personal Account number and the documents needed to consider it.
9.3. A claim is considered within 30 days from the date of its registration (clause 7 of Article 55 of the Federal Law "On Communications"); the response is sent in writing or electronically to the contacts specified in the Contract. The Operator responds to requests without demands (questions, applications for a change of services) within 10 working days.
9.4. The Subscriber informs the Operator of errors in charges and invoices immediately after discovering them.
9.5. Compliance with the claim procedure is mandatory before going to court (Article 55 of the Federal Law "On Communications"). Disputes with legal entities and sole proprietors are considered by the Arbitrazh (Commercial) Court of Khabarovsk Territory. An individual may go to court in accordance with the rules established by consumer protection legislation.
9.6. If a service is provided by the Partner (24TV), claims regarding its quality and content are considered by the Partner; the Operator accepts such claims and forwards them to the Partner (section 12).
10. Liability of the Parties
10.1. The parties are liable for non-performance of obligations in accordance with the law (Chapter 9 of the Federal Law "On Communications", Government Resolutions No. 2606 and No. 2607), the Contract and the Rules.
10.2. The Operator ensures Network availability of at least 97% of the time per month, excluding scheduled technical breaks (clause 6.1) and the circumstances of clauses 10.3 and 10.7.
10.3. The Operator is not liable for poor-quality provision of services caused by:
- malfunction or settings of the Subscriber's equipment and software, including Wi-Fi;
- damage to the wiring in the Subscriber's premises, the subscriber line and equipment on the Subscriber's side (clause 5.2.1) or a power outage there;
- the speed and operation of websites and networks of other operators outside the Network;
- restriction of access to resources as required by law;
- non-compliance by the Subscriber with the Rules, including transfer of the Subscriber's credentials to other persons.
10.4. Recalculation. If, through the Operator's fault, Internet access on the Personal Account was unavailable for longer than clause 10.2 allows (more than 3% of the time in a month in total, about 21 hours), the subscription fee for Internet access is recalculated in proportion to the total time of the breaks in that month (in hours, an incomplete hour counting as a full hour). The recalculation is made upon the Subscriber's application (clause 9.1) submitted within 6 months (clause 9.2); the time of the break is determined from the Subscriber's fault report and the Operator's monitoring data. The recalculation amount is credited to the Personal Account no later than the month following the month in which the application was submitted. Breaks due to circumstances on the Subscriber's side (malfunction of the Subscriber's equipment, no access to the premises at the agreed time) and circumstances under clauses 10.3 and 10.7, as well as scheduled technical breaks (clause 6.1), are not recalculated. The part of the subscription fee for television under an "Internet + TV" plan, TV services and 24TV packages are not recalculated (clause 12.10). The penalty payable to individuals is in the amount established by law.
10.5. In relations with legal entities and sole proprietors, the Operator does not compensate indirect losses and lost profits; its liability is limited to recalculation under clause 10.4 and penalties expressly provided for by law. The rights of individuals as consumers are always determined by law and are not limited by this clause.
10.6. The Subscriber is responsible for the content of information transmitted from the Subscriber's connection and for the actions of persons to whom the Subscriber has given access, and compensates for damage caused to the Operator's Network and equipment through the Subscriber's fault.
10.7. The parties are released from liability in the event of force majeure circumstances: natural disasters, fires, mass power outages not caused by the fault of the parties, decisions of state bodies, military operations and other unavoidable events.
11. Internet Access and IP Addresses
11.1. The access speed specified in the tariff is the maximum speed on the segment from the Subscriber's equipment to the Operator's external channel. The speed of exchange with a particular website also depends on the networks of other operators and on the website itself. The traffic volume is not limited, unless otherwise specified in the tariff.
11.2. IP addresses. The Operator does not use network address translation (NAT): for each connection, the Subscriber receives one external (public) IP address from the Operator's address space.
- By default, the address is dynamic: it is issued at each connection and may change on reconnection.
- A static address is a separate paid service; the address is assigned to the Subscriber and specified in the Connection Application. If the Subscriber gives up the service or the Contract is terminated, the address is returned to the Operator.
11.2.1. Under a Connection Application, the Subscriber is provided with a subnet of external addresses (from 4 addresses and larger) from the Operator's address space; the fee is according to the tariff. The addresses are assigned for the term of the Connection Application and are returned to the Operator upon its termination.
11.3. The Operator restricts access to resources included in the registers of prohibited information in the manner established by law. Apart from this, the Operator does not control the content of information on the Internet and is not responsible for it.
11.4. Network usage rules. The following are not permitted: mass mailings without the consent of the recipients (spam); distribution of malware; attacks on and scanning of other people's systems; illegal distribution of copyrighted works; other actions that violate the law or interfere with the operation of the Network. Response procedure:
- first complaint - a warning to the Subscriber;
- repeated complaints - suspension of services until the cause is eliminated;
- an attack or infection interfering with other subscribers - immediate restriction of access with subsequent notice.
11.5. Complaints about violations from the Operator's addresses are sent to the complaints address in section 13.
12. 24TV Interactive Television
12.1. Interactive television is provided by "24 Hours TV" LLC (ООО "24часа ТВ") (the 24TV service, hereinafter the Partner). The Operator acts as an agent on the basis of agency agreement No. К02/0218 of 16.03.2018: it connects the Subscriber to the service, accepts payment for television from the Personal Account, manages packages and accepts requests.
12.2. The viewing conditions, the composition of packages, the number of channels and the rules for using the content are determined by the Partner and its user agreement, which the Subscriber accepts in the 24TV app. The composition of packages may change by decision of the Partner and the right holders. The service page for the Operator's subscribers: https://24h.tv/provider/bravotelecom; the lists of channels in the packages are on the Operator's website.
12.3. Television is connected in one of the following ways:
- an "Internet + TV" plan - an Internet access tariff plan whose subscription fee includes the 24TV package specified in the tariff (clause 12.5);
- a TV service - a 24TV package connected as an additional service to any Internet access tariff plan (clause 12.6);
- a 24TV package connected by the Subscriber in the 24TV app, paid from the Personal Account (clause 12.7).
The list of "Internet + TV" plans and TV services, their prices and the places where they are provided are set out in the tariffs.
12.4. Signing in to the app. The Subscriber installs the 24TV app on a Smart TV, set-top box, smartphone, tablet or computer and signs in with their telephone number. The first sign-in is made via the Operator's network at the connection address: this is how the service links the 24TV account to the Subscriber's Personal Account. Television under a tariff plan or TV service appears in the app automatically after connection.
12.5. "Internet + TV" plans. The subscription fee of the plan includes the fee for the 24TV package: under the BRAVO ТВ 100 and BRAVO ТВ 300 plans - 229 RUB per month, BRAVO ТВ 300+ and BRAVO ТВ 500 - 349 RUB, BRAVO Кино 500 START and BRAVO Кино 500 AMEDIATEKA - 449 RUB, BRAVO Премиум 500 - 790 RUB; the rest of the subscription fee is the fee for Internet access. The package under a plan is changed only by changing the plan (clause 4.5). If, before switching to an "Internet + TV" plan, the Subscriber had a package connected in the app, it remains valid until the end of the paid period and is not renewed.
12.6. TV services. One TV service per Personal Account is connected to an Internet access tariff plan. For the first (incomplete) month, the fee is debited in proportion to the days until the end of the month, and then on the 1st day together with the subscription fee (clause 8.2). When a TV service is disconnected, the unused part of the fee is returned to the Personal Account. To get more channels, the Subscriber changes the TV service to another one. A TV service is not needed on "Internet + TV" plans.
12.7. Packages in the app. The Subscriber may connect additional packages in the 24TV app (to an "Internet + TV" plan or a TV service) or a package without them. The fee is debited from the Personal Account at the price shown in the app. A package is valid for 1 month from the moment of connection and is renewed automatically if there are sufficient funds in the Personal Account; if the funds are insufficient, the package is not renewed and no debt arises. A trial period is provided by the Partner on its terms published on the Operator's website. For a package not to be renewed or to be terminated early, the Subscriber notifies the Operator in the Customer Account, by email or by phone with confirmation by the code word: the 24TV app has no such function. In the case of early termination, the fee is recalculated in proportion to the days from the date the request is registered; no recalculation is made for the period before the request.
12.8. Insufficient funds. When Internet access is suspended due to insufficient funds (clause 3.4), television under an "Internet + TV" plan, a TV service and packages connected in the app are suspended together with it and resume automatically after payment. The term of a paid package is extended by the days of suspension.
12.9. When topping up the Personal Account, the Subscriber takes all payments into account: the subscription fee (on the 1st day) and the fee for packages in the app (on the day of renewal). The Subscriber sees the amount payable in the Customer Account.
12.10. The 24TV service is available to the Subscriber via any Internet connection, not only via the Operator's network. Therefore, a break in Internet access via the Operator's network, including one caused by the Operator's fault, is not a break in the provision of the 24TV service: in a recalculation (clause 10.4), the part of the subscription fee for television under an "Internet + TV" plan, the fee for a TV service and 24TV packages are not recalculated.
12.11. Viewing requires a Smart TV, a set-top box or a mobile device with the 24TV app. The picture quality depends on the Internet access speed and the Subscriber's Wi-Fi network.
12.12. The Partner is responsible for the content of TV channels, changes to their list and the broadcast schedule. The Operator is responsible for delivering the signal over the Network. Copying and public display of content without the permission of the right holders are prohibited. The Operator accepts claims about the quality and content of the service and passes them on to the Partner (clause 9.6).
12.13. Under these Rules, television is provided to a Subscriber who is an individual only for personal, family and household viewing. Showing TV channels in places open to the public (cafes, restaurants, hotels, shops, waiting rooms, offices with visitors, etc.) constitutes public display and is not permitted under these Rules. "Internet + TV" plans, TV services and 24TV packages are not provided to legal entities and sole proprietors under these Rules; terms for organizations are available on request.
13. Final Provisions and Contacts
13.1. The Rules are published on the Operator's website with the date of the edition. Previous editions are kept on the Operator's website in the "Documents" section. Changes take effect no earlier than 10 days after publication (clause 6.1).
13.2. Notices sent to the Customer Account, to the Subscriber's email or telephone number from the Contract, or via EDI have the force of written notices and are deemed received on the day following dispatch. The Subscriber is responsible for keeping the Subscriber's contacts up to date (clause 7.1).
13.3. Operator's contacts. The Operator works remotely; there is no office for receiving visitors. Written requests are accepted by email, in the Customer Account, via EDI or by post to the legal address. Working hours: requests and messages in the Customer Account and by email are accepted around the clock and registered by the time of receipt; they are considered during working hours in order of receipt, with outage reports first. Calls are accepted, and connection, repairs with a visit and other work at the Subscriber's premises are carried out Monday to Friday from 9:00 to 18:00, with a break from 13:00 to 14:00 Khabarovsk time; Saturday, Sunday and non-working public holidays are days off; the Operator announces changes to the working hours on the website and in the Customer Account; outside these hours, requests are sent in writing. Subscribers that are legal entities and sole proprietors are given, when concluding the Contract, a telephone number at which requests are accepted around the clock; the number is specified in the Connection Application.
